Estate Planning Terms

  1. Will A document which authorises a person (executor/trustee) to distribute your assets (estate) after your death to the person or persons you nominate (beneficiary). A will only takes effect upon your death.

  2. Enduring Power of Attorney A document which authorises a person (Attorney) to act as your agent during your lifetime to deal with your legal and financial affairs. A Power of Attorney ceases to have effect upon your death

  3. Advance Care Directive A document which expresses your wishes regarding health care, end of life matters, accommodation and personal decisions (including refusals of care), and allows you to appoint a person (Substitute Decision Maker) to make those decisions if you are unable to make your own decisions (e.g. if you can’t understand information about the decision, understand / appreciate the risks and benefits involved, remember the information for a short time, or tell someone your decision and why you have made it).

Fees

Fixed fees will generally apply for a ‘standard’ Will, e.g. if your entire Estate is left to your partner or (if s/he dies before you) to your children equally.

Further fees will likely apply if you require any of the following:

  • Different terms in each of your Wills (in the case of a couple)

  • Additional provisions in your Will – e.g. numerous specific bequests, life interests/right to reside, testamentary trusts – simple, complex, protective, special disability trusts;

  • Advice on:

    • People you are excluding on your Will, who may claim on your Estate under the Succession Act 2023;

    • Blended families – i.e. you or your partner have children from a previous relationship;

    • Contracts for mutual wills.

  • Reviewing:

    • Family Trust Deeds and including clauses on appointors;

    • complicated superannuation arrangements or self‐managed superannuation funds (SMSF’s); or

    • company ownership of assets

  • Preparation of a Binding Death Benefit Nomination form for a self‐managed superannuation fund.

  • Travel/Home visits
