Nic Kernahan

Nic has been a lawyer for 25 years.  He has extensive experience as an advocate in almost all jurisdictions however in most recent years this has been in Criminal prosecutions in the Supreme, District and Magistrates Court. As well as family law and wills and estates matters.

In 1994, Nic started with Johnston Withers Lawyers as the resident solicitor in our fledgling Whyalla Practise.  He lived in Whyalla for three years before returning to Adelaide.  He has however, continued to attend the Whyalla office every fortnight to assist clients in Town.

Nic’s favourite thing about Whyalla is the durability and optimism in the community which explains why it has been able to endure so many economic roller coaster rides over the period of his connection to the town.  He also likes that the town prides itself on sporting achievements and sense of community.

When asked about one case at the Whyalla practice that stands out for him, he highlights being seconded to the Coronial inquiry into the crash of a Whyalla Airlines aircraft on the 31st May 2000. The crash had an enormous impact on the local community. The Coroners inquiry questioned the findings of the national investigation by the Australian Transport and Safety Bureau, and through an exhaustive investigation which endured over a period of about 2 years, and having travelled to the United States to take evidence from experts there, we were able to demonstrate and the Coroners found, that the ATSB report was wrong. The findings were of considerable relief to the Whyalla community and the families of those that died in the crash. The Coroners inquiry provided a rigorous, logical and scientifically sound conclusion to the tragedy which the families could find comfort.

Emma Wilkinson

Emma Wilkinson is Johnston Withers’ wills and estates expert. She has been specialising in wills and estates law for over 10 years so there is not much she doesn’t know about preparing wills, obtaining probate, managing estates and resolving estate disputes. It is work that she loves – and given that many of her new clients are referred by her former clients – it is work at which she obviously excels.

Emma’s other area of practice is family law. She appears regularly in the Family Court and Federal Circuit Court for hearings relating to divorce, property settlement and children’s issues.

Emma joined Johnston Withers in 2005, initially working in the Port Augusta office. While now based in Adelaide, she remains committed to the firm’s regional offices in Port Augusta and Roxby Downs. She maintains her practice in these areas and visits regularly.

Prior to joining the firm Emma practiced for 12 months in commercial law and general practice in Hobart, Tasmania. She brings a clear commercial eye and a wide perspective to all that she does. She also brings her formidable negotiation skills and her constructive approach to problem solving. She prides herself on being responsive to clients, straight talking, realistic in her advice, and cost conscious.
